Terms and Conditions
- General
These terms and conditions pertain to Thalatrading CV, conducting business under the trade name Corpus Analyser AI. They are an integral part of all offers presented by Thalatrading CV and all agreements to be entered into by Thalatrading CV. Thalatrading CV explicitly rejects the applicability of any purchasing and/or other terms and conditions put forth by the buyer and/or participant (hereinafter referred to as “participant”). In the event that one or more provisions of these terms and conditions are deemed null and void, the remaining provisions shall remain in full force. Any additions, modifications, and/or supplementary agreements are valid only if made in writing.
- Offers
All offers are non-binding unless explicitly stated otherwise in writing by Thalatrading CV. We reserve the right to make changes to the product range and composition.
- Products and Software
Thalatrading CV provides equipment for the analysis of vital human body information.
- Warranty
The warranty for Corpus Analyser deliveries is valid for 2 years from the date of delivery.
- Returns
Customers have the right to return internet-purchased equipment within 14 days of receipt. The transportation costs to Thalatrading are the responsibility of the customer. Corporate clients or business partners may only return equipment with the consent of Thalatrading CV. Transportation costs to Thalatrading are at the customer’s expense.
- Prices
We reserve the right to implement future price adjustments. The contract is established based on the prices set by Corpus Analyser at the time of the purchase agreement. Current price information is available on Corpus Analyser’s websites.
- Delivery
Delivery is Word Wide. Unless expressly otherwise agreed, delivery is always made “ex” Corpus Analyser. Unless otherwise stipulated, the products shall be transported at the expense and risk of the customer.
Shipping is done by courier and can be followed through a track and trace code.
- Delivery Time
The delivery time, to the best of Corpus Analyser AI’s knowledge, is non-binding and does not constitute a strict deadline for Corpus Analyser. In the absence of an agreed-upon delivery time, Corpus Analyser must deliver the products within a reasonable timeframe.
Under normal circumstances physical products will be sent within 5 businessdays.
- Payment
All products are ordered through Corpus Analyser AI’s websites. Payment is required at the time of ordering.
- Advertising & Limitation of Liability
If the purchaser believes that the delivered products do not conform to the agreed specifications, written notice of the defect must be provided to Corpus Analyser within 7 days of receiving the products. In the unlikely event that the delivered products fail to meet the agreed specifications, Corpus Analyser, at its discretion, will replace the products with equivalent new items upon their return in their original condition or provide fair compensation up to the invoice value of the delivered products. Corpus Analyser is not obligated to any obligations beyond those described in the preceding sentence. Except in cases of intent or gross negligence on the part of Corpus Analyser, Corpus Analyser shall not be liable for trading losses or any other direct or indirect damages incurred by the participant as a result of delayed, incorrect, or defective deliveries or defects in the delivered products. In any event, Corpus Analyser’s liability to the participant, for any reason, is always limited to a maximum of the invoice value of the delivered products.
- Indemnification
The participant indemnifies Corpus Analyser against all claims from third parties related to products supplied by Corpus Analyser to the participant, which may have caused damage to third parties, regardless of the cause or timing of such occurrences.
- Disputes
For dispute resolution, please refer to the Online Dispute Resolution (ODR).
- Applicable Law
All agreements entered into under these terms and conditions shall be exclusively governed by Dutch law.
